Suspect in armed robbery may sue Good Samaritan who stopped him

FRESNO, Calif. – A Good Samaritan who stepped in to do what police say was the right thing could soon be sued by the robber he stopped.

In July, Fresno police say 30-year old Ryan Flores used a gun to try to rob a Starbucks.

Cregg Jerri stepped in to stop the crime, and the two got into a fight. Both men were hurt, but the Flores family told CBS affiliate KGPE-TV that their son plans to sue Jerri for excessive force.

Flores is facing a felony attempted robbery charge. His mother, Pamela Chimienti, said the family does not condone the alleged crime, but she said Jerri went too far when fighting back.

"The guy, in my opinion, went from a Good Samaritan to a vigilante," Chimienti said. "Stabbing somebody that many times, it doesn't take that many stab wounds to get somebody to succumb to you."

Fresno Police Chief Jerry Dyer disagrees, calling Jerri a hero.

"To say that Cregg Jerri is going to be sued for intervening in an armed robbery and being stabbed in the neck. That is ludicrous!" Dyer said.

Flores is in jail on $155,000 bond. He's due back in court in October.
