Diesel was found dead in April in the back of a patrol vehicle parked outside the courthouse in Melbourne.
Court documents revealed that investigators believe Diesel was left in the vehicle for several hours.
Police said there is a heat alarm system that is supposed to go off if the vehicle becomes too hot, but lawyers for Antosia said he was in a backup vehicle and the heat alarm system was not set up the same way.
