ORLANDO, Fla. – A man accused of killing a woman at her downtown Orlando apartment in 2015 appeared in court for the final time before his trial begins.
Stephen Duxbury, 35, was working as a security guard at Uptown Place Condominiums the night 27-year-old Sasha Samsudean was murdered.
On Wednesday, Circuit Judge Leticia Marques briefly addressed a recent motion filed by the defense.
"You'll get your order on the motion to suppress probably on Friday," Marques said.
Duxbury's attorneys filed documents on Monday asking the judge to not allow sneakers collected at Duxbury's home to be admitted as evidence.
The motion stated that analysis shows the shoes only appeared to match a footprint found inside Samsudean's apartment and that a conclusive association was never made.
"The conclusions and opinions regarding the alleged sneaker shoe prints in this case are nothing more than conjecture and speculation and should not be admitted as evidence," defense attorney Cheney Mason stated in the motion.
The state has since filed a response asking the untimely motion be struck by the court or denied because of its merits.
The judge said any other motions will need to be filed by Thursday.
Duxbury faces charges of first-degree murder, attempted sexual battery with a deadly weapon and burglary.
Jury selection for the trial is scheduled to begin Monday at 9 a.m.
