Florida man accused of choking cop after dine and dash at pizza place

ORLANDO, Fla. – An Orlando man who allegedly refused to pay his bill at a downtown pizza restaurant Monday night is accused of choking one of the cops trying to arrest him, according to an arrest affidavit.

Daniel Robinson, 22, faces charges of attempted homicide on a law enforcement officer, two counts of resisting an officer with violence, two counts of resisting an officer without violence, battery, petit theft, criminal mischief less than or equal to $200 and three counts of battery on a law enforcement officer, records show.

Officers responded around 10:45 p.m. to The Corner Pizza Bar at South Magnolia Avenue and East Church Street, where staff were reportedly outside and pointing Robinson out. The 22-year-old had allegedly refused to pay a bill of about $50.50 before pushing the owner out of the way and leaving the restaurant prior to the officers’ arrival, according to the affidavit.

Now inside the business with police, Robinson said that he couldn’t pay because his phone was dead, yet an officer noticed Robinson’s phone was lighting up, the affidavit states.

The staff at this point wished to trespass Robinson, who then sat in a chair next to the door, police said. Following multiple attempts to get his name, the report states Robinson only said that his first name was “Daniel” and that both his middle and last names were “pendejo,” prompting the officers to grab his arms and try to arrest him.

Robinson allegedly braced his body and stopped the officers from putting him on the ground, according to the affidavit. While the officers tried to grab Robinson’s legs, he managed to stand up and push one officer away while reportedly getting his arm around the other’s neck.

The officer whom Robinson allegedly grabbed then said, “He’s choking me,” and hearing this, the other officer tried to pull Robinson away before delivering closed-fist strikes to Robinson’s face, the affidavit states.

The officer continued to punch Robinson once he was on the ground, police said. While on his stomach with his arms near his face, Robinson reportedly continued resisting, kicking toward officers until one of them used a burst of a chemical agent to briefly gain his compliance and put him in handcuffs, according to the affidavit.

Robinson was further restrained with a RIPP Hobble before deliberately spitting on an officer and being taken to a hospital, the affidavit states.

He’s being held without bond at the time of this report.
