Arrest made after man fatally shot in Lake Markham Woods subdivision near Sanford

SANFORD, Fla. – An arrest was made after a man was fatally shot late Tuesday in a Seminole County neighborhood, sheriff’s officials said.

The shooting was reported around 11:30 p.m. in the 7400 block of Colonial Court in the Lake Markham Woods subdivision near Sanford.

The Seminole County Sheriff’s Office said a man was shot and taken to a hospital, where he died. His age has not been released.

Deputies said the suspect remained at the scene and was taken into custody.

“This is believed to be an isolated, domestic incident and there is no continuing danger to the area,” the sheriff’s office said.

The suspect was identified as 42-year-old Shaun Simon, of Sanford, records show. According to his arrest report, Simon faces a charge of first-degree murder in the shooting.

The document goes on to describe deputies’ response to the subdivision, where they reported arriving to see Seminole County Fire Rescue personnel performing life-saving measures to an elderly male who appeared to have been shot once in the chest.

The victim, identified as Bill Toth, was pronounced dead at a hospital at 2:17 a.m. Wednesday, deputies said, adding he had been hospitalized in critical condition.

Two alleged witnesses — described as the victim’s wife and adult daughter — were taken to the sheriff’s office for questioning, wherein they provided similar accounts of the events leading up to the daughter’s 911 call, according to the report.

The daughter told investigators that Bill Toth had been exhibiting signs consistent with dementia for several months, what she said had caused ongoing turmoil in the household, the report states.

Continuing, the daughter reportedly said that Bill Toth physically slapped his wife Tuesday evening amid suspicions he had been unfaithful to her, according to the report. After the wife then entered a bedroom and told Simon and the daughter what happened, Simon is accused of exiting the room and confronting Bill Toth. The wife and daughter “reported hearing a loud ‘bang’ shortly thereafter,” the report states.

Simon’s first appearance in court is scheduled for Wednesday afternoon.
