ORLANDO, Fla. – Surveillance video capturing a fatal shooting outside an Orlando nightclub last weekend will be shown in court Monday, defense attorney Mark O’Mara told News 6.
Last week, Jean Gabriel Borja Gil De La Madr was charged with second-degree murder in the shooting death of 33-year-old Julien Cruz. Days later, he retained O’Mara as his attorney.
“Obviously there’s a lot to get ready for,” O’Mara said Sunday. “We have gotten a lot of discovery in from the state over the weekend, so we have a feel for what’s going on.”
O’Mara spoke to News 6 outside the Orange County Jail, where he was preparing to visit Borja Gil De La Madr ahead of a court hearing scheduled for Monday.
The hearing is expected to address a motion O’Mara filed asking the judge in the case to set a bond for his client.
In the motion, O’Mara wrote that Borja Gil De La Madr “poses no probability of danger to the community in which he lives, should he be released on bond.”
In a press release after Borja Gil De La Madr’s arrest, Orlando Police said the agency’s investigation revealed a verbal and physical altercation preceded the shooting outside Savoy Orlando, a nightclub on North Orange Avenue.
“During the dispute, the suspect retrieved a firearm from his vehicle and shot the victim,” the release stated.
O’Mara does not dispute that his client shot Cruz, but rather, he contends the shooting may have constituted an act of self-defense.

“As you’ll see in the video tomorrow, there was no aggression in the way my guy approached him,” O’Mara said.
The video, O’Mara said, is a nearby business’s surveillance footage that appeared to capture the incident.
“I think most compelling is one quite grainy video of the actual event,” O’Mara said.
O’Mara said he was unable to release the footage prior to Monday’s hearing.
