‘May not survive:’ Drunk driver gets angry after striking bystander, Palm Bay police say

PALM BAY, Fla. – A drunk driver was placed behind bars this week after he brutally struck a pedestrian, which made him upset over the damage to his car, according to the Palm Bay Police Department.

In a probable cause affidavit, police said that the driver — identified as Daniel Davis, 61 — was spotted pulling out from the parking lot of a bar along Dixie Highway late Tuesday night.

An officer said he followed Davis, noticing that the car was drifting out of the lane. That’s when a call came in for a vehicle fire close by.

“Your Affiant saw (Davis) approach the vehicle, which was smoking,” the affidavit reads. “Your Affiant saw (Davis) appeared to impact the driver’s side of the vehicle and then saw a pedestrian being thrown from the hood/windshield of his vehicle. It is likely the pedestrian was standing at the driver’s door of the vehicle.”

As a result, the officer pulled Davis over and went out to check on the pedestrian, who was unresponsive in the center of the road, bleeding heavily on the ground, court records show.

However, police added that Davis seemed more concerned about his own vehicle.

“Your Affiant noticed (Davis) was upset over the pedestrian he had just struck damaging his window, at a point asking if he was going to pay for it,” the affidavit continues.

Investigators also noted that Davis wasn’t able to find his car registration or driver license, and he seemed “unsteady or clumsy as he walked about,” with the smell of alcohol on his breath.

According to the affidavit, Davis admitted to having four or five beers while at the bar, rating himself as a “six” on a scale of 1 - 10 for inebriation.

“The pedestrian that had been struck at least had broken right leg in addition to the internal injuries, and it was likely he may not survive,” police wrote.

Now, Davis faces charges of DUI with an underage person in his vehicle, and DUI with serious bodily injuries to another. He is held on bond of $450,000.
