ORLANDO, Fla. – A new lawsuit is taking aim at a Westgate resort in Orlando after a 1-year-old baby stumbled across a spoon contaminated with fentanyl.
The lawsuit, filed on Friday morning, says that the baby — identified only as “M.S.” — was visiting Westgate Lakes Resort & Spa with his family back in May 2024.
But while inside the hotel room, M.S. found a spoon beneath a sink within the cabinet area, the lawsuit states.

“The spoon was not part of a secured or sealed inventory and was not stored in a manner preventing access,” the lawsuit reads. “M.S. placed the spoon into his mouth. Shortly thereafter, M.S. became unresponsive and lost consciousness.”
Afterward, M.S. was taken to the hospital, and a toxic substance believed to be fentanyl was discovered both in M.S.’ system and on the spoon itself, the lawsuit reveals.

“The dangerous condition was latent and not open and obvious to Plaintiff or his guardians,” the lawsuit continues. “Neither Plaintiff, nor anybody in Plaintiff’s party created the condition.”
Now, M.S.’ family is accusing the resort of negligence, seeking over $50,000 in damages.
