BREVARD COUNTY, Fla. – The man police said killed a teenager during a late night altercation in downtown Melbourne might have to go back to jail before his trial starts.
Stephan Dieujuste is accused of killing 19-year-old Nate Jennings.
Dieujuste was able to bond out of jail because he was only facing a manslaughter charge.
However, once the state attorney’s office reviewed the case, it upped Dieujuste’s charge to murder.

Prosecutors on Thursday sought to revoke his bond and send him back to jail during a bond hearing.
An attorney for the state called Melbourne police Sergeant Edwin Carlson to the stand.
“And after he fires that first shot, does he stop?”
“He does not,” Carlson answered. “He fires several more times.”
“And what is Mr. Jennings doing when he’s being shot by Mr. Dieujuste?”
“Initially, Mr. Jennings, kind of like, retreated and fell backwards,” he said. “And then, as he continued to retreat, he started to move northbound in the roadway as Mr. Dieujuste continued to shoot.”
Another angle of the shooting was presented in court for the first time.
Attorneys examined surveillance from a building next to the parking lot.
Like the phone video of the shooting Brevard County community correspondent James Sparvero reported about in May, because Jennings died, News 6 chose to pause the new video just before he was shot.
Dieujuste’s attorney argued Jennings was the instigator and was looking for a fight.
“Nobody knows why Mr. Jennings was going after Mr. Dieujuste - why he kept trying to fight him, why he kept trying to engage him,” Scott Robinson said.
Judge Steve Henderson said he wants more time to look over the new evidence like the surveillance, so he said he’s continuing the bond hearing until sometime next week.
