EDGEWATER, Fla. – City leaders in Edgewater on Monday voted to defy a new state law and not repeal the city’s current moratorium on new construction.
The building ban was put in place to give the council more time to come up with solutions to years of flooding issues.
A law passed by the state legislature this year officially bans the local restrictions, but many homeowners pushed back saying the city needed to take a stand.
SB-180 prohibits local governments from enacting temporary bans on new construction.
Last month, city leaders acknowledged that while SB-180 might have been intended for good, it could hurt communities like theirs.
In the end, the final vote was 3-2 to keep the ordinance in place.
The city attorney has warned the move could result in lawsuits against the council and possible removal from office for council members.
