Teacher, former union president faces termination over not reporting sexual behavior between students, district says

BREVARD COUNTY, Fla. – A former president of the teacher’s union who Brevard Public Schools says didn’t report when two students had sex at school could be fired by the end of the month after 32 years with the district.

Mark Levine, attorney for Space Coast Junior/Senior High School teacher Dan Bennett, told school board members Tuesday the allegations from the district aren’t true.

A press release reads, “In September 2025, two students engaged in oral sex while Mr. Bennett was responsible for supervising them.”

“Whoever put this out ought to be ashamed of themselves,” Levine said at Tuesday’s board meeting. “They embarrassed a 32-year employee with no discipline.”

Levine argued DCF and the Brevard sheriff’s office have cleared Bennett of any criminal wrongdoing.

School board member Meghan Wright agreed about the teacher’s exceptional record while adding more to the debate.

“It doesn’t take away the fact that he is still required, as is every other employee of our district, to report anything that they suspect when a child is potentially in danger,” Wright said.

The district hasn’t said if this happened in Bennett’s classroom or if he even knew about it, but Wright said two other adults were in the room.

Your Viera Community Correspondent James Sparvero asked the district if they were teachers, too, but the district didn’t tell him Tuesday.

They’re under investigation, as well, and while Bennett’s attorney was at the school board meeting, Bennett himself did not show.

“To bring this out about Mr. Bennett is just another strike at the union,” Levine said.

Ultimately, on Tuesday, the board voted to keep Bennett on leave and out of the classroom, but they’re paying him again.

He was previously on unpaid leave for the last two weeks.

Bennett still faces being fired.

The board’s scheduled to vote on his termination on the 31.
