VOLUSIA COUNTY, Fla. – The man accused of shooting a Volusia County deputy last month was back in court Thursday as his defense team moved to block the public release of recordings tied to the case.
Luis Diaz Polanco, 31, faces two counts of attempted murder after investigators say he opened fire on Deputy Jose Rivera during a call at a Deltona home on Candler Drive in March.
Attorneys reached an agreement that about 14 pages of a 53-page transcript from Polanco’s confession will remain sealed. The remaining pages can eventually be released as public record.
Deputies said Polanco shot Rivera in the leg and shoulder. One of the bullets struck Rivera’s body camera, which was at the center of his chest.
“Thank God for his body camera, takes a round dead center in through the body camera, which we believe then ricochets through his shoulder,” Volusia County Sheriff Mike Chitwood said during a news conference at the shooting scene.
Chitwood also said the accused shooter told detectives he had every intention of shooting deputies and would have killed them if he had not run out of ammunition.
