OVIEDO, Fla. – An 11-year-old Oviedo boy is scheduled to appear in court Tuesday after police cited him while he was riding an electric dirt bike on Labor Day.
Cade Kirchner was pulled over by Oviedo police, fingerprinted and cited. His family said his bike was also towed.
According to the family, one of the citations involves operating an unregistered motor vehicle. Police described the bike as an electric motorcycle.
Cade’s parents said they acknowledge he was in the wrong, but they believe a warning would have been more appropriate.
“The whole thing is stressful,” Cade’s mother, Gina Dougherty, said.
Cade said he has been struggling with the situation and is worried about appearing in court.
“I’m feeling very scared,” he said. “I’d rather be in school instead of being at court.”
Cade’s father, Chris Kirchner, previously called the case “one of the most absurd over-reaches of justice I’ve ever seen.”
On Monday, Chris said he recently spoke with the State Attorney’s Office and was told prosecutors are pursuing charges. The office did not specify what those charges would be.
“I don’t even know what I’m scared about,” Cade said. “It’s a different environment.”
Chris said he hopes the charges are dropped and that his son can return to school without having to repeat the experience.
