Deputies said the father had purchased a property in the area about six to eight months ago, but it had just recently been surveyed. The father and son said they were walking the property when they came across a man on an ATV, Kilburn, and waved to him, records show.

The father and son said Kilburn became angry and started cursing at the pair, deputies said. Kilburn demanded to know what the father and son were doing on his property and would not listen when they tried to explain that they had recently purchased the property, according to the arrest affidavit.

The pair said Kilburn eventually pulled out a rifle and leveled it at both men while shouting threats, such as “I’m going to kill you.”

Deputies then made contact with Kilburn. The man admitted to seeing two people in the woods and having a confrontation with them but denied ever pulling a gun, deputies said. The father identified Kilburn as the man who threatened him and his son, records show.

Kilburn faces a charge of aggravated assault with a deadly weapon with intent to kill.
