ORLANDO, Fla. – Rapper Kodak Black’s attorney is asking an Orange County court to release his client from all bail requirements, arguing that prosecutors missed a legal deadline to file formal charges following a May drug trafficking arrest.
The motion, filed Monday in the Ninth Judicial Circuit Court for Orange County, points to a Florida rule requiring prosecutors to formally charge a defendant within 60 days of arrest.
Bill Kapri — known professionally as Kodak Black — was arrested May 6 on a felony charge of trafficking MDMA. Under Florida law, the 60-day deadline to file formal charges fell on July 5. According to the motion, no information or indictment has been filed.
Florida law gives courts two options when a defendant remains uncharged past the 60-day mark: automatically release the defendant on their own recognizance on the 63rd day, or — if the state shows good cause — extend pretrial release for up to 30 additional days. The motion asks the court to release Kapri from all bail conditions unless the state can establish good cause.

The Orange County Sheriff’s Office arrested Kapri following an investigation that traced back to a November 2025 incident at the Children’s Safety Village on Fairvilla Road. Deputies responding to calls about gunshots found two vehicles and — after detecting the smell of burnt cannabis — searched them. Inside a pink bag, they found what appeared to be MDMA.
According to the arrest warrant affidavit, the pink bag matches one visible on Kapri’s Instagram account. The Florida Department of Law Enforcement confirmed the substance was MDMA and in a trafficking amount, with the lab report returned April 17.
At a May bond hearing, a judge set bond at $75,000, citing Kapri’s 12 prior felony convictions. Kapri later bonded out.
