VOLUSIA COUNTY, Fla. – Jury selection is expected to get underway on Monday in Volusia County for the trial of a mother charged with attacking a school resource deputy.
Dagmarie Aponte Iturrino and her husband, Jorge Rivera, went to Deltona Middle School in 2024 after their son was handcuffed following an incident involving another student. The couple also said their son had been bullied. A verbal confrontation turned physical.

Deputies said Rivera punched School Resource Deputy Julia Curtin, knocked her down, and took her Taser. Curtin then drew her gun. Aponte was arrested and charged with battery on a law enforcement officer and resisting with violence.
Aponte initially entered a no-contest plea, then asked a judge to withdraw it, claiming she did not fully understand her options.
The judge allowed the withdrawal, clearing the way for this week’s trial. The case is expected to last about two days.
Jurors are expected to see body camera video of the confrontation.
Rivera pleaded no contest to robbery, resisting arrest, battery and grand theft and received 45 days in county jail — prompting Sheriff Mike Chitwood to publicly blast Circuit Judge A. Kathleen McNeilly.
