Florida man sues Dunkin’ over toilet ‘explosion’ that he says left him filthy, injured

Lawsuit accuses Dunkin’ Donuts of negligence after man was injured in explosion

WINTER PARK, Fla. – A Flagler County man is suing a Dunkin’ Donuts after he suffered from a toilet “explosion” nearly two years ago, according to court documents filed on Wednesday.

The lawsuit says that the man — Paul Kerouac — was visiting a Dunkin’ Donuts location along Aloma Avenue in Winter Park around Jan. 6, 2022.

While at the store, a toilet in the men’s bathroom exploded, covering the bathroom and Kerouac in human feces and urine, the lawsuit claims.

Court records show that Kerouac then came out from the bathroom, asking employees at the store for help cleaning himself.

Around this time, employees told Kerouac that they were aware of the “problem with the toilet” due to prior incidents, according to the lawsuit.

“(Kerouac) requires mental health care and counseling as a direct result of the trauma experienced in the restroom at Defendant’s business and from the continuing trauma following the event,” the lawsuit reads.

The lawsuit also says that Kerouac suffered “severe and long-term injuries” due to the toilet explosion.

As a result, the lawsuit accuses the Dunkin’ Donuts of negligence, failing to properly maintain the toilet or warn Kerouac ahead of time.

Kerouac is seeking damages over $50,000.
