She told deputies she went to sleep on Tuesday and awoke around 4 a.m. the next morning to find Rico Johnson sexually abusing her. He told deputies he was asleep and did not see or hear anything. Evidence was collected from Johnson’s clothing and deputies found reason to believe Johnson sexually battered the victim.

The 65-year-old victim said he didn’t know why Kress hit him and his only explanation was that he might have bumped into him while he was drinking and playing pool. Records show the victim suffered a rupture spleen, which had to be surgically removed, and five fractured ribs. When he was interviewed on Sept. 29, Kress said the victim was intoxicated and as a result, lost his balance and “landed” on him, records show. He denied causing the serious injuries the victim suffered but admitted that he left the bar because he was afraid he would be arrested.

Police said the 70-year-old victim was at a Citgo on Orange Avenue around 7:40 p.m. on Tuesday when he noticed Rovester Ingram was not wearing a mask, so he asked Ingram to social distance. The victim was on his stomach as Ingram repeatedly punched him in the head, then spat on him, kicked him in the head and walked away, according to the affidavit. When police arrived, the victim told them, “This guy just beat the hell out of me.” Records show he suffered serious injuries, including broken bones. Ingram said the victim was “getting crazy” and being “aggressive” so he just “snapped” and hit the elderly man in the face, the affidavit said.

One of the other residents of the home told deputies the victim and the accused shooter, Cameron Sanford, 30, had an ongoing dispute. A witness told investigators Sanford left a note for the victim about the food. The victim went upstairs to confront Sanford and demand some items back he said Sanford had been borrowing, according to the report.

Evan Maness, 33, has been charged with lewd and lascivious behavior in the presence of a juvenile victim and driving with a suspended license. Police said around 4 p.m. Monday officers received a call from the victim about the incident in the area of Trotwood Park. Investigators said the suspect asked the victim for directions and performed a lewd act in front of the teen as he got closer. Authorities said investigators were able to find Maness and arrest him in about thirty minutes after the victim called dispatchers.
